Personal Alcohol Licence Renewal

Renewal of a personal licence in England & Wales…. THE FACTS

The first batch of personal alcohol licences granted under the licensing Act 2003 covering England and Wales will be up for renewal in February 2015. Personal licence holders must complete and submit the relevant renewal form to the Licensing Authority that originally granted their licence no later than one month before their licence expires.

Licence holders will also have to enclose their personal licence or a copy. Section 119 of the Licensing Act 2003 provides that where an application for renewal is pending and the application has not been determined before the licence expires, the licence continues to have effect. To ensure that applicants have certainty that their forms have been received, licensing authorities should acknowledge receipt of the application.

Need to refresh licence training

Since the introduction of licensing Act 2003 which came into force in August 2oo5 there have been many substantial changes to the Act. The original licensing qualification has also changed it’s name form the NCPLH to the the Award for Personal licence Holders (APLH) Level 2. Although there is no Government or legal requirement to undertake retraining all Managers, Owners and Supervisors involved in the sale of alcohol have a legal responsibility under a premises licence to demonstrate due diligence regarding alcohol licensing law in England and Wales. Therefore we would advise all old licence holders, especially licence holders granted under Grandfather rights to undertake training for the new licensing qualification known as the (APLH) Level 2.
