Refresher Training for Personal Licence Holders in Scotland

Refresher Training is Required after Five Years Don’t Forget!

All personal licence holders in Scotland who had their licence issued on or before 1st September 2009 must now have completed their SCPLH refresher training.
Under section 87(3) of the Licensing Scotland Act 2005 a requirement to undertake refresher training in licensing laws after five years, then providing evidence no later than 3 months, after the 5th anniversary of the issue of the licence. This evidence (certificate or a copy of the certificate of refresher training) must be presented to the Licensing Board that issued the licence together with details of personal licence holder’s full name, address, date of birth, and personal licence number.

When the original Scottish personal licenses were issued it was to cover a period of 10 years or if issued prior to September 1st it was deemed that that all licenses were issued on September 1st 2009 and accepted as the start date to cover the next ten years. What may not have been taken into account that refresher training must be undertaken by all personal licence holders after five years of holding the licence. Personal licence holders in Scotland must be aware and understand the implications of not complying as this may have serious consequences.

If you choose to ignore advice from Licensing Boards and not supply evidence as others have prior to the 1st of September the Licensing Board must revoke the personal licence. Apparently Boards have no discretion in this matter the penalty is revocation.

Should a person who has failed to comply have their personal licence revoked, who happens to be the Designated Premises Manager then they could bring the premises licence into contention. Please do not ignore the importance of SCPLH refresher training and providing evidence to the Licensing Board within the time frame.

In England and Wales personal licence reissues will become due in August 2015 we of course will keep you up-dated on all licensing issues regarding renewing your personal alcohol licence closer to the first date for licence renewals.
